Pyrotechnics

The following information should answer most of your questions regarding the use of pyrotechnics at the Thomas & Mack Center and Cox Pavilion. Please consult with the Facility Event Production Manager in advance to determine if a local pyrotechnician is necessary, based on the particulars of your specific event. It is to your advantage to get a determination well in advance of your scheduled event to avoid delays, overtime, or cancellation of scheduled display(s).


If your intent includes pyrotechnics as part of your event, the following policy is now in affect in the Thomas & Mack Center and Cox Pavilion. This policy is in accordance with State of Nevada Fire Marshal and Federal regulations, guidelines and standards. Be prepared to adhere to the following:

  1. Notify the Facility Event Production Manager at least ten (10) working days in advance of your intent to use pyrotechnics.
  2. If you do not already have a Nevada licensed pyrotechnician, the Event Production Manager can provide you with a list of local licensed technicians or can arrange for their services directly. The pyrotechnician, in affect, will be an independent contractor working for you during your event.
  3. You must provide the State Fire Marshal and Facility Event Production Manager with a Certificate of Insurance that includes the seven (7) items listed under INSURANCE (see page 2). It must be in the State Fire Marshal office at least five (5) working days prior to your event.
  4. Your Nevada licensed pyrotechnics technician is responsible for pulling the local permit with the State Fire Marshal as well as making certain that the Certificate of Insurance is on file with the State Fire Marshal. In addition, the pyrotechnician will arrange for a demonstration of the effects with the State Fire Marshal. The pyrotechnician must be on site for said demonstration and whenever the pyrotechnics are used.
  5. You will be responsible for all fees associated with the use of pyrotechnics during your event. These include the permits necessary from the State Fire Marshal, and Fire Marshal inspections or demonstrations, as well as the local licensed pyrotechnician’s fees.
  6. Supply your Nevada licensed pyrotechnician with the information necessary to pull the permits at least five (5) working days prior to your event.


Any presentation at the Thomas & Mack Center or Cox Pavilion, containing pyrotechnics, must be compliant with the Nevada State Fire Marshal Code. Permit and insurance requirement is the sole responsibility of the hosting party.

Insurance
The Certificate of Insurance (one million dollar liability policy) shall include all of the following:

  1. The deductible, if any, cannot exceed fifteen thousand dollars ($15,000.00).
  2. Certificate of Insurance must have policy including limit for bodily injury stated as no less than fifty thousand dollars ($50,000.00) for a single person or one hundred thousand dollars ($100,000.00) for each additional occurrence annually.
  3. Limits of property damage liability of not less than twenty five thousand dollars ($25,000.00) for each occurrence, as payment of damages to persons or property. Which may result from, or be caused by such public display of fireworks, or any negligence on the part of the licensee or his or its agents, servants, employees, or subcontractors presenting such public display.
  4. A written statement saying the insurer will not cancel the insured’s coverage without fifteen (15) days prior written notice to the State Fire Marshal.
  5. That the duly licensed Nevada pyrotechnic operator required by law to supervise and discharge the public display, acting either as an employee of the insured or as an independent contractor and the State of Nevada, its officers, agents, employees, and servants are included as additional insured’s, but only insofar as any operations under contract are concerned.
  6. That the Thomas & Mack Center and/or Cox Pavilion shall not be responsible for any premium or assessments on the policy.
  7. That the Thomas & Mack Center, Cox Pavilion, University of Nevada Las Vegas Board of Regents, and their officers and employees listed as additional insured.

Permit
When applying for permit as required by Item 4 on page 1 of pyrotechnics requirements, applicant shall submit information and evidence to the State Fire Marshal covering the following:

  1. A list including name of organization sponsoring display of events, including individual names held responsible for the display(s) itself.
  2. The exact date and time of day for planned display(s) to take place.
  3. The exact location where planned display(s) to take place.
  4. The name and license number of Nevada pyrotechnic operator supervising discharge of the fireworks.
  5. The class of fireworks discharged and the number of set pieces, shells, effects, or other items such as rockets, missiles, or experimental devices.
  6. Location and manner of storing fireworks both prior to display(s) as well as during display(s) itself.
  7. A diagram of the grounds on which display planned, showing the point at which the fireworks discharged.
    1. OUTSIDE: Location of all buildings, highways, and other lines of communications, lines behind audience restraint, location of nearby trees, phone lines, and other overhead obstructions.
    2. INSIDE: Shot-sheet, audience location(s), discharge locations(s), storage location(s), and storage device(s), and location(s) of fire extinguishers.
  8. Proof that satisfactory compensation insurance carried for all employees.
  9. Document containing proof and confirmation, including insurance section of this policy.
  10. License issued by Nevada State Fire Marshal specifically for Public Display of Fireworks.
  11. The name and license number of the wholesaler supplying items used in the display(s).
  12. Permit holder responsible for compliance with the provisions under which a public display(s) permit granted.
  13. Within, at least, ten (10) working days prior to event, proof of compliance with above mentioned is required on file with the office of the State of Nevada Fire Marshal.
